Automated Digital Control System Installed Qualifies as MCI

Landlord applied for MCI rent hikes based on the installation of a new heating system. The DRA ruled for landlord in part, disallowing any increase for an automated digital control system. Landlord appealed and won. While the control system, in and of itself, wasn't an MCI, it consisted of computers, software, and programming that synchronized the operation of the building complex's three heating plants. The control system was a necessary component of the overall heating system and was installed in connection with the new heating system. So it qualified for an MCI rent hike.
