Asbestos Logbook Was Incomplete

DEP issued violation notices to landlord and asbestos abatement contractor for not keeping a record of asbestos abatement activities in a logbook. Landlord was removing asbestos from pipes on the building's stairwells. City regulations require a log to be kept on site with a record of all people who enter the asbestos work area, what kind of protection the workers wear, and what equipment they use. The ALJ found that landlord's log complied with city regulations and dismissed the violations. DEP appealed, claiming that the logbook was incomplete.

The inspector said only five workers had signed the logbook on the inspection date, but there were another six workers who hadn't signed in. The workers also didn't sign in and out when they took a break. ECB ruled for DEP. All workers must sign the log upon each entry and exit from the asbestos work area, which wasn't done here. Landlord was fined $12,650.
