Area Within Vacant Lot Not Covered by Litter Law

DOS issued a violation notice to landlord for having a dirty area in a vacant lot she owned. The inspection report showed scattered litter. Landlord claimed that there was no legal violation. The ALJ ruled against landlord and fined her $50. Landlord appealed. ECB ruled for landlord. The antilittering law, Code Section 16-118(2), applied only to owners of buildings and required them to keep sidewalks and curbs abutting buildings clean. It didn't apply to vacant lots.
