Application to Modify Lobby Attendant Service Denied

Landlord asked the DHCR for permission to modify lobby attendant services at its rent-regulated building complex in 2018, by replacing 24/7 lobby attendants with a virtual door attendant service. The DRA ruled against landlord in separate identical orders for different buildings in the complex.

Landlord asked the DHCR for permission to modify lobby attendant services at its rent-regulated building complex in 2018, by replacing 24/7 lobby attendants with a virtual door attendant service. The DRA ruled against landlord in separate identical orders for different buildings in the complex.

Landlord appealed and lost. Landlord claimed that the DRA failed to provide notification that the DHCR approval also was required for replacement of a traditional entry key system with a key fob or keycard entry system. Landlord had replaced the key system with a key fob system without DHCR permission prior to filing its application concerning the lobby attendant service. And the DRA denied landlord's request to amend its application to include the installation of the key fob/keycard system. The DHCR noted that the DRA properly denied the application since it would have to resend any amended application to tenants for comment. In the meantime landlord had filed a separate application for the key fob installation, which was granted by the DRA in December 2020. Landlord could file another modification of service application for permission to modify the lobby attendant services.
