Applicable Guidelines if Landlord Uses Heat Pumps

Landlord asked the DHCR which rent guidelines apply to its building under RGBO 37. RGBO 37 applied different rent increases to buildings where landlord paid for heat than where tenant paid for heat. Landlord used heat pumps and provided additional heating through electrical current supplied by tenants. In an opinion letter, the DHCR said that for purposes of RGBO 37, landlord didn't provide heat, because the heat pumps alone couldn't provide adequate heat to apartments.
