Apartments with Same Number of Rooms Used as Comparables

Tenant complained of a rent overcharge. Tenant was the first rent-stabilized tenant in the apartment after vacancy decontrol. The DRA found that tenant's rent exceeded the fair market rent, and directed a refund. Landlord appealed, claiming that it wasn't given the chance to submit comparability data. The DHCR agreed and accepted landlord's proof of comparable rents from apartments in different lines that had the same number of rooms. This reduced the amount of overcharge.
