Apartment Used for Illegal Sale of Drugs

Landlord sued to evict tenant because her apartment was used for the illegal sale of drugs. Tenant claimed she was out of the country when the apartment was raided and didn't know anything about the illegal activity. The court ruled for landlord. Landlord brought the case after authorization by the district attorney's office. Police had gotten a search warrant and seized drug paraphernalia, telephones, beepers, and a knife from the apartment. It didn't matter that tenant wasn't there or wasn't directly involved in the illegal activity.
