Apartment Used as ‘Crack House’

LVT Number: 6981

Landlord sued to evict tenant from a federally subsidized apartment for using that apartment as a ``crack house.'' The Nassau County trial court dismissed landlord's petition, finding that landlord hadn't sent tenant a notice required under federal regulations. Landlord appealed. The appeals court found that the federal regulations in question didn't require service of a notice in this case, based on tenant's alleged illegal use of the apartment. The case was sent back for trial.
