Apartment Rented After Building Converted to Co-op

The DRA ruled that tenant's Long Beach apartment was subject to Emergency Tenant Protection Act (ETPA) coverage. Landlord appealed. The DHCR noted that by local law, owner-occupied co-op apartments in Long Beach had been deregulated from the ETPA in 1992. Landlord claimed that tenant didn't move into the apartment until after the building's co-op plan was declared effective. Tenant offered no proof to the contrary. So, the apartment wasn't subject to the ETPA.
