Apartment Owned by Nonprofit Institution on Base Date

Tenant complained of a rent overcharge. The DRA ruled against tenant. Tenant appealed and lost. On the base date, four years before the filing of tenant's complaint, the apartment was owned by a nonprofit institution and occupied by students of the institution. So the apartment was exempt from rent stabilization on the base date. Any prior rent history can't be examined under the four-year time limit. So tenant's rent, set after the apartment was exempt, became the legal rent.
