Apartment Occupied by Transient Hotel Guest on Base Date

Hotel-stabilized tenant complained of a rent overcharge. The DRA ruled against tenant. Tenant appealed and lost. The apartment had either been vacant or occupied by a transient hotel guest on the base date, four years before tenant filed his complaint. So the base rent for purposes of calculating the legal rent was tenant's initial rent of $1,200 per month. There was no overcharge.
