Apartment Improvements Rent Increase Brings Rent to $2,000 or More

Landlord asked the DHCR if apartment improvements made during a vacancy that resulted in a new rent of over $2,000 deregulated an apartment. In an opinion letter, the DHCR explained that whether the apartment was deregulated depended on when the vacancy and rerenting of the apartment occurred. If the vacancy occurred prior to April 1, 1997, any rent increase that brought the next rent to $2,000 or more caused deregulation. If the rerenting occurred after June 15, 1997, deregulation also applied.
