Air Conditioner No Longer Fits in Sleeve

Tenant complained of a reduction in services, claiming that landlord removed a living room air conditioner. The DRA ruled against tenant because an inspection found that the service was being maintained. Tenant appealed, pointing out that his complaint was that the air conditioner no longer fit into the recently replaced wall sleeve. The DHCR ruled for tenant. The inspector's report was incorrect. At the inspection, it was noted that the air conditioner wasn't in the sleeve and that the new sleeve was too narrow for the air conditioner to fit in.
