Adequate Lighting Provided in Hallway, Lobby, Entrance

Tenant complained of a reduction in services. The DRA ruled for tenant based on a finding of inadequate lighting in the building's vestibule. Both landlord and tenant appealed. Landlord claimed that lighting in the vestibule was adequate. Tenant claimed that there should be an additional finding of inadequate lighting in the hallway, lobby, and building entrance. The DHCR ruled against both landlord and tenant. An inspection found that both the main entrance light outside the building and the vestibule ceiling light were on a timer.

The inspection also found that the lobby area had one light on the ceiling and one light on the wall. The light on the ceiling, which was on a timer, was off during the inspection. The light on the wall in the hallway was on, creating adequate light in the hallway. The second- and third-floor hallway lights, which were on a timer, weren't on during the inspection, but there was adequate natural light in these areas.
