10% Increase for Grandniece

Landlord asked the DRA to increase rent-controlled tenant's rent based on an additional apartment occupant. The DRA ruled for landlord. Tenant appealed, claiming that the occupant was her grandniece, who had already moved out. The DHCR ruled against tenant. At least for the period that her grandniece was living in the apartment, landlord was entitled to a 10 percent rent increase. A grandniece isn't an immediate family member exempt from the additional occupant rent increase.
